Permanent Labor Certification (PERM)

U.S. Employers who wish to hire foreign workers to work permanently in the United States can file an application for permanent labor certification with the U.S. Department of Labor (DOL).  During the application process, the employer must file a request for a Prevailing Wage Determination from DOL based on the job title and requirements of the position and undergo recruitment in order to demonstrate to DOL that there are not sufficient domestic workers who are able, willing, qualified or available for the job and that employing the foreign workers will not adversely affect the wages and working conditions of U.S. workers working in similar positions.

U.S. Employers must obtain a Labor Certification from DOL before submitting their application to U.S. Citizenship and Immigration Services (USCIS).  With an approved application, the employer offers the permanent position to a foreign worker, who applies for legal permanent resident status based on the employer’s permanent job offer.
